1. Acceptance of Terms
By accessing and using the Origins Family Foods website and online store (the "Store"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (the "Agreement"). If you do not agree to these terms, please do not use the Store. Origins Family Foods reserves the right to modify these terms at any time, and your continued use of the Store constitutes acceptance of any changes.
2. Account Creation and Registration
To place orders on our Store, you may be required to create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate accounts that violate these terms or engage in fraudulent activity.
3. Product Descriptions and Pricing
We strive to provide accurate descriptions of our products, including ingredients, origins, and nutritional information. However, we do not warrant that product descriptions, images, or information are entirely accurate, complete, or error-free. Prices are subject to change without notice and are valid only at the time of purchase. We reserve the right to refuse or cancel orders if pricing errors occur.
All product images are for illustrative purposes. Actual products may vary in appearance, packaging, or branding. Product availability is limited to quantities on hand, and we reserve the right to limit quantities per order.
4. Ordering and Payment
When you place an order, you are making an offer to purchase products at the prices and terms displayed. We reserve the right to accept or decline any order at our sole discretion. Orders are not confirmed until we send you an order confirmation email. Payment must be received before we process and ship your order.
We accept major credit cards, debit cards, and other payment methods displayed at checkout. By providing payment information, you authorize us to charge the full order amount, including applicable taxes and shipping fees. You represent and warrant that you are authorized to use the payment method provided.
5. Shipping and Delivery
We aim to process and ship orders within 1-2 business days. Delivery timeframes vary by region and carrier and are provided as estimates only. We are not responsible for delays caused by carriers, weather, natural disasters, or other circumstances beyond our control. Risk of loss transfers to you upon delivery to the carrier.
We currently ship to addresses in the continental United States only. We do not ship to P.O. boxes, military addresses, or international locations at this time.
6. Returns and Refunds
Unopened, non-perishable items may be returned within 14 days of purchase for a full refund (less shipping costs). Perishable items, including fresh produce, spices, and prepared foods, cannot be returned once delivered due to food safety regulations. Items must be in original condition and packaging. Refunds are processed within 5-7 business days after receipt and inspection of returned items.
Items damaged or lost during shipping should be reported within 48 hours of delivery. We will work with carriers to file claims and issue replacements or refunds as appropriate.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ORIGINS FAMILY FOODS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE STORE, INCLUDING DAMAGES FOR LOSS OF PROFITS, DATA, OR OTHER INTANGIBLES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS THAT GAVE RISE TO THE CLAIM.
8. Intellectual Property Rights
All content on the Store, including text, images, logos, graphics, and product descriptions, is the exclusive property of Origins Family Foods or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, transmit, display, or modify any content without our prior written consent.
9. Privacy
Your use of the Store is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and use of your personal information.
10. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts in the location where Origins Family Foods operates.
11. Dispute Resolution
Any disputes arising from these Terms and Conditions or your use of the Store shall first be addressed through good faith negotiation. If negotiation fails, either party may pursue legal action in accordance with applicable law.
12. Amendments
Origins Family Foods reserves the right to amend these Terms and Conditions at any time. Amendments become effective upon posting to the Store. Your continued use of the Store following the posting of amendments constitutes acceptance of the modified terms.
